Kim Kardashian is facing a defamation lawsuit after mistakenly identifying a New York man as a death row inmate on Instagram, causing him public humiliation and emotional distress.
In her post, Kardashian wrote, “The state will execute Ivan Cantu in 2 days,” alongside a black-and-white photo of the wrong Ivan Cantu. She urged her millions of followers to sign a petition to stop the execution.
However, the actual convict, Ivan Cantu, was executed by lethal injection on February 28, 2024, while the man in Kardashian’s post—a Middletown, New York resident—had no connection to the case.
The lawsuit, filed in Los Angeles, claims the misidentification caused severe emotional and psychological harm. The plaintiff’s attorney, Greg Sobo, stated, “At the time Kardashian publicly defamed him, he was mourning a personal loss. This mistake violated his privacy and caused lasting trauma.”
Responding to the lawsuit, Kardashian’s lawyer, Michael Rhodes, acknowledged the error but defended her intentions, saying, “It was an honest mistake—she used a public photo of another man with the same name while advocating for criminal justice reform.”
Kardashian has been a vocal advocate for prison reform in recent years, gaining attention for lobbying former President Donald Trump to commute Alice Marie Johnson’s life sentence for a non-violent drug offense. However, this legal battle now raises questions about the responsibilities of public figures when using social media for activism.
